This Decree applies to officials and civil servants working in agencies of the Party, State, Vietnam Fatherland Front, and political and social organizations affiliated with the Vietnam Fatherland Front at the commune, ward, and special zone levels.

According to regulations, commune-level officials and civil servants who are not entitled to additional salary or income as stipulated in the resolutions of the Provincial/City People's Council are entitled to a public service allowance equal to 55% of their current salary, plus leadership position allowance and seniority allowance exceeding the standard rate (if any).

For commune-level officials and civil servants who receive additional salary and income according to resolutions of the Provincial/City People's Council, the public service allowance is equal to 25% of their current salary, plus leadership position allowance and seniority allowance exceeding the standard rate (if any).

In cases where the salary and additional income received by commune-level officials and civil servants is lower than the 55% public service allowance, the recipient will be paid the difference to ensure it reaches the 55% public service allowance.

The public service allowance is paid together with the monthly salary and is not used for calculating social insurance or health insurance contributions and benefits.

The decree also stipulates several periods of time during which allowances are not granted, including: time spent on business trips, work, or study abroad while receiving 40% of the salary as prescribed; unpaid leave of one month or more; leave of absence while receiving social insurance benefits; and time spent under temporary suspension from work or temporary detention.

Funding for the civil service allowance scheme is secured from the state budget and included in the annual salary reform needs of local authorities.

Decree No. 381/2026/ND-CP takes effect from October 2, 2026; the above-mentioned allowance regime will be applied from July 1, 2026 until the implementation of salary policy reform.
