On the afternoon of October 3rd, the Committee on Culture and Social Affairs reviewed and commented on the draft Law amending and supplementing a number of articles of the Law on Physical Education and Sports , the Law on Tourism, the Law on Libraries, the Law on Cinematography, the Law on Cultural Heritage, the Law on Advertising, and the Law on the Press.

In the report on the draft Law, Deputy Chairman of the Committee on Culture and Social Affairs Ta Van Ha stated that the Committee agrees with the necessity of promulgating the draft Law amending and supplementing a number of articles of the Law on Physical Education and Sports, the Law on Tourism , the Law on Libraries, the Law on Cinematography, the Law on Cultural Heritage, the Law on Advertising, and the Law on Journalism for the reasons stated in the Government 's submission.

The amendments and additions aim to promptly institutionalize the Party's views, policies, and guidelines on reforming and reorganizing the state apparatus; promote decentralization and delegation of power; reduce and simplify administrative procedures and investment and business conditions; promote digital transformation ; ensure the uniformity and consistency of the legal system under the operation of a two-tiered local government; and resolve difficulties and obstacles in the practical implementation of laws in the fields of culture, sports, and tourism.

According to Deputy Chairman of the Committee on Culture and Social Affairs Ta Van Ha, the Committee basically agrees with the scope of amendments and additions to the draft Law. Taking into account the opinions of the National Assembly Standing Committee and the preliminary review opinions of the Standing Committee on Culture and Social Affairs, as well as the review opinions of National Assembly agencies, the drafting agency has reviewed and removed 13 new policy contents from the draft Law that have not been fully assessed for impact, to be further studied during the comprehensive revision of specialized laws.

Compared to the draft Law submitted to the Standing Committee of the National Assembly, the revised draft Law focuses on addressing issues that are truly necessary, urgent, and have sufficient political , legal, and practical basis.

The Committee noted that the revisions and amendments to the draft Law demonstrated a spirit of innovative thinking in legislative work, only stipulating content that is "well-established and clear," of a principled nature, and content that falls within the authority of the National Assembly.

The Committee believes that the draft Law's dossier has been prepared seriously and fully in accordance with Clause 3, Article 37 of the Law on Promulgation of Legal Normative Documents. However, the Committee requests the drafting agency to further review the consistency between the draft Law and the draft decrees and circulars providing detailed guidance on its implementation to ensure that all assigned contents are fully guided and to ensure consistency in the draft Law's dossier.

Regarding specific issues, Deputy Chairman of the Committee on Culture and Social Affairs Ta Van Ha stated that, concerning the amendment and supplementation of some articles of the Law on Physical Education and Sports, the Committee agrees with the scope of amendment and supplementation of the Law on Physical Education and Sports, mainly focusing on implementing the requirements of promoting decentralization and reducing administrative procedures.

The Ministry of Culture, Sports and Tourism is reviewing and summarizing the shortcomings and obstacles, especially the new issues arising in the practical management of state affairs in physical education and sports. Based on this, it will propose comprehensive amendments and additions to the Law on Physical Education and Sports during the 16th National Assembly term.

The Committee agrees with the proposal to decentralize some powers from the Prime Minister to the Ministers in charge of specific sectors and fields, thereby facilitating the implementation of the Law.

Regarding the amendment and supplementation of several articles of the Tourism Law, the Committee agrees with the drafting agency's decision to incorporate the conclusions of the National Assembly Standing Committee and preliminary review opinions, removing seven groups of content from the draft Law that have not been fully assessed for impact. These include the mandatory purchase of travel insurance for international tourists entering Vietnam, the responsibilities of online travel agencies, and the arrangement of tourism promotion personnel at Vietnamese representative offices abroad.

At the same time, the authority of the provincial-level tourism specialized agency in Articles 50, 51, and 56 is retained, addressing the issue of transferring authority from lower to higher levels.

Regarding the amendment and supplementation of several articles of the Library Law, the Committee agreed with the amendments to the Library Law (4 out of 52 articles) focusing on decentralization and delegation of authority, in line with the two-tiered local government model; not adding specific regulations in the Law on other library services (point e, clause 3, Article 28); and acknowledged the feedback and explanations from the drafting agency, continuing to research policies on ordering and purchasing books from the state budget, investing in shared digital libraries, and developing school books when comprehensively amending the Library Law.

Regarding the amendment and supplementation of several articles of the Law on Cinematography, the Committee agrees with the drafting agency's incorporation of the conclusions of the National Assembly Standing Committee and the preliminary review opinions: withdrawing the amendment and supplementation of point b, clause 2, Article 21 concerning the obligations of film distribution entities, not requiring entities distributing films on the internet to be recognized as meeting the film classification requirements, thus avoiding the creation of administrative procedures; and retaining the provisions on "project investors" in clauses 3 and 4, Article 14.

We agree with the Government's explanation regarding the basis for shortening the processing time for film licenses and the regulations on the State guaranteeing and supporting budget for film production serving political purposes (Clause 2, Article 4 and Clause 4, Article 8 of the draft Law).

Regarding amendments and additions to certain articles of the Law on Cultural Heritage, the Committee agreed with the draft Law revised based on feedback from the Standing Committee of the National Assembly and the reviewing agency, including the removal from the draft Law of provisions amending and supplementing the title of Article 29 and Clause 3 of Article 32, thereby avoiding the interpretation that permits the construction of new structures in areas protected as world heritage sites.

At the same time, we agree with the amendment of point b, clause 1, Article 35 to only require confirmation of degradation for historical relics that need to have a planning document but have not yet had one, thus narrowing the scope of the administrative procedure.

We request that the drafting agency review this content and include strict regulations in the detailed document, ensuring that professional standards are not lowered and the level of protection for the historical site is not diminished.

Regarding amendments and additions to certain articles of the Advertising Law, the Committee agreed with the amendments and additions to the Advertising Law concerning management tools to replace outdoor advertising planning; approved the replacement of the phrase "audio and visual media" with the phrase "radio and television broadcasting," ensuring consistency with the 2025 Press Law; and acknowledged the need for continued research on regulations concerning advertising in printed books and electronic publications when amending the Advertising Law at an appropriate time.

Regarding amendments and additions to certain articles of the Press Law, the Committee agrees with the amendment and addition to Clause 3, Article 18 of the Press Law, whereby press agencies only need to notify when changing certain contents recorded in their press operating licenses in the fields of radio and television broadcasting and content regarding the publication of supplements, without having to go through the approval procedure, contributing to the reduction and simplification of administrative procedures.
