According to Ms. N., prior to the commune merger, she worked at the Commune People's Committee as an accounting officer, holding the rank of assistant officer. After July 1, 2025, she was transferred to work as an accountant at the Commune Party Committee office.

By July 2025, Ms. N. graduated from university and applied for a promotion from the assistant officer rank to the specialist rank. However, the Party Building Committee of the commune stated that there were no specific guidelines and that the consideration and decision rested with the competent authority of the provincial Party committee.

Ms. N. asked whether her case would qualify for a promotion from assistant officer to specialist.

In response to this issue, the Ministry of Interior cited point a, clause 1, Article 9 of Government Decree 361/2025, which stipulates that civil servants assigned to a particular job position shall be classified in the corresponding rank according to that job position.

The classification of professional and technical civil servants must be based on the job description and competency framework of the job position.

Therefore, having a university degree does not automatically mean a civil servant can be promoted from the assistant officer rank to the specialist rank.

The crucial factor is whether the job position to which the civil servant is assigned requires a specialist rank and whether the civil servant meets the standards for that position.

Notably, according to the Ministry of Interior, in cases where civil servants are assigned to positions with a higher professional rank than their current rank, the provisions of point b, clause 4, Article 23 of Decree 170/2025, as amended and supplemented by Decree 300/2026, shall apply.

According to the new regulations, there are no longer requirements regarding the length of time spent in the immediately lower rank or the requirement to be in the same industry or field, unlike the previous regulations on civil servant promotion examinations and assessments.

The Ministry of Interior stated that when assigning civil servants to professional or technical positions with a higher rank than their current rank, the head of the agency employing the civil servant must develop a plan for changing the job position. This plan must be reported to the civil servant management agency for approval before implementation.

The plan includes evaluation criteria, principles, and methods for selecting civil servants to be assigned to new positions, ensuring suitability with the specific operational characteristics of the agency, organization, or unit.

In addition to the requirements stipulated in the job description and competency framework for the position, the employing agency may define additional criteria to select individuals who meet the requirements for placement in a higher-ranking position.

The selection of civil servants is carried out in order of evaluation results from highest to lowest, ensuring openness, transparency, objectivity, and compliance with regulations.

Therefore, whether or not someone can be promoted to the specialist rank depends not only on their qualifications, but also on the assigned job position, job description, competency framework, and the selection criteria of the employing agency.

The Ministry of Interior requests that Ms. N. contact the civil servant management agency where she works for consideration and resolution within their authority, based on Articles 67 and 68 of Decree 170/2025.
