On October 3rd, the Committee on Culture and Social Affairs held its 4th plenary session to review 8 draft laws to be submitted to the National Assembly at the second session of the 16th National Assembly.

Attending and giving a directive speech at the session, Vice Chairwoman of the National Assembly Nguyen Thi Thanh clearly stated that the areas under the Committee's purview are directly related to people and social life. Therefore, during the review process, the Committee needs to pay special attention to the legitimate rights and interests of the people, closely adhering to the requirements of national development and the issues arising from practical realities.

Emphasizing several general requirements in the review process, the Vice Chairman of the National Assembly suggested continuing to improve the quality of reviews, ensuring that the review report clearly reflects the viewpoint of the reviewing agency. Key issues and policies with significant impact need to be fully analyzed based on their political , legal, and practical foundations, with impact assessments and clear statements of viewpoints and proposed solutions, providing the National Assembly with a basis for consideration and decision-making.

The Vice Chairman of the National Assembly requested that discussions be conducted in a democratic, objective, scientific , and responsible manner; that issues with differing opinions be addressed frankly and thoroughly; and that difficult issues not be avoided, thereby clarifying the basis and rationality of each policy option.

The Vice Chairman of the National Assembly noted the need to pay special attention to the consistency, uniformity, and feasibility of policies. Given that many laws are being amended and supplemented simultaneously, each draft law must be considered within the overall legal system and related policies. It is crucial to avoid amending one law to resolve a bottleneck while simultaneously creating new bottlenecks in another law.

For major, complex issues with wide-ranging impacts, it is necessary to fully utilize the results of practical surveys, expert opinions, and the opinions of those affected, ensuring that policies, when enacted, are truly feasible and effective in practice.

Following the directive from Vice Chairwoman of the National Assembly Nguyen Thi Thanh, the Committee on Culture and Society reviewed five draft laws, including: the Law amending and supplementing a number of articles of the Labor Code, the Law on Archives, the Law on Gender Equality, the Law on Red Cross Activities, the Law on Employment; the Law amending and supplementing a number of articles of the Law on Occupational Safety and Health; the Law amending and supplementing a number of articles of the Law on Social Insurance; the Law amending and supplementing a number of articles of the Law on Physical Education and Sports , the Law on Tourism, the Law on Libraries, the Law on Cinematography, the Law on Cultural Heritage, the Law on Advertising, the Law on the Press; and the Law on the Development of the Cultural Industry.

The Committee generally agrees with the need to amend and supplement several articles of the Labor Code, the Archives Law, the Gender Equality Law, the Red Cross Activities Law, and the Employment Law.

Regarding specific issues, such as labor leasing, the Committee generally agrees with the abolition of business conditions for labor leasing activities and the shift from a licensing mechanism to a notification system, aiming to reduce and simplify business conditions, lower compliance costs, and create favorable conditions for businesses.

However, removing the current regulations on licensing for labor leasing activities could reduce the effectiveness of screening and controlling businesses from the moment they enter the market, while increasing risks for leased workers. Therefore, the Committee proposes improving the post-inspection mechanism to ensure effective state management, avoid creating "legal loopholes," and promptly protect the legitimate rights and interests of workers.

Specifically, the agency in charge of drafting the Law should include additional research on the responsibility for building, updating, and exploiting an electronic database on labor leasing enterprises and leased workers, serving the purposes of management, inspection, handling violations, risk management, preventing abuse, and protecting the legitimate rights and interests of workers.

Regarding holidays, the Committee approved adding Vietnamese Culture Day as a public holiday with full pay for employees; and considered the proposal to add July 27th - the annual War Invalids and Martyrs Day - as a public holiday.

Regarding the draft Law amending and supplementing several articles of the Law on Physical Education and Sports, the Law on Tourism, the Law on Libraries, the Law on Cinematography, the Law on Cultural Heritage, the Law on Advertising, and the Law on Journalism, the Committee agrees on the necessity of amending and supplementing these seven laws to promptly institutionalize the Party's views, policies, and guidelines on reforming and reorganizing the state apparatus; promoting decentralization and delegation of power; reducing and simplifying administrative procedures and investment and business conditions; promoting digital transformation; and resolving difficulties and obstacles in the practical implementation of laws in the fields of culture, sports, and tourism.

The Committee recommends that the drafting agency, during the process of revising and finalizing the draft Law, should continue to study, review, and closely follow the draft Laws submitted to the National Assembly for consideration and approval at the Second Session of the 16th National Assembly to ensure the consistency of the legal system.

New policies that have not been fully explained or assessed for their impact require further thorough research and evaluation, and proposals for amendments and additions should be made during the comprehensive revision of existing laws.
