Decree 381/2026/ND-CP: Commune-level officials and civil servants are entitled to a 55% public service allowance.

This Decree applies to officials and civil servants working in agencies of the Party, State, Vietnam Fatherland Front, and political and social organizations affiliated with the Vietnam Fatherland Front at the commune, ward, and special zone levels (hereinafter referred to as commune-level officials and civil servants).

Public service allowance

Decree No. 381/2026/ND-CP stipulates the following rates for civil service allowances:

1. The public service allowance, equal to 55% of the current salary plus leadership position allowance and seniority allowance exceeding the standard rate (if any), is applied to commune-level officials and civil servants who do not receive additional salary or income as stipulated in the Resolution of the Provincial/City People's Council on the payment of additional salary and income.

2. The public service allowance, equal to 25% of the current salary plus leadership position allowance and seniority allowance exceeding the standard rate (if any), is applied to commune-level officials and civil servants who receive additional salary and income according to the Resolution of the Provincial/City People's Council on the payment of additional salary and income.

3. In cases where commune-level officials and civil servants mentioned in Clause 2 above receive a salary or additional income lower than the 55% public service allowance, they are entitled to the difference to bring it up to the 55% public service allowance.

Deputy Prime Minister Pham Thi Thanh Tra stated that, following a review of one year of implementing the two-tiered local government model, the Central Committee decided to increase the allowance for commune-level officials and civil servants from 25% to 55%, an increase of 30%.

This is a policy prioritized by the central government for the commune level, stemming from the practical requirements of the two-tiered local government model, in which the commune level is where many tasks are directly carried out, issues are resolved, and services are provided to the people.

The increase in allowances is a specific policy aimed at creating more motivation and enhancing responsibility in performing public duties within the new organizational model. The adjustment of allowances is linked to the requirement of continuing to build a team of grassroots officials who can better meet the requirements of governance and serving the people in the two-tiered local government model.

Principles of application

The public service allowance is paid together with the monthly salary and is not used for calculating social insurance or health insurance contributions and benefits.

Periods not eligible for civil service allowance include:

- During business trips, work, or study abroad, employees are entitled to 40% of their salary as stipulated in Clause 4, Article 8 of Government Decree No. 204/2004/ND-CP dated December 14, 2004, on the salary regime for officials, civil servants, public employees, and members of the armed forces;

- Periods of unpaid leave lasting one month or more;

- Period of leave for which social insurance benefits are received as prescribed by the law on social insurance;

- The period of temporary suspension from work or temporary detention/custody.

Officials and civil servants at the commune level who cease working in agencies of the Party, State, Vietnam Fatherland Front, or political and social organizations affiliated with the Vietnam Fatherland Front at the commune, ward, or special zone level will no longer receive the civil service allowance under this Decree from the following month.

The funding for the civil service allowance stipulated in this Decree is secured from the state budget and included in the annual salary reform needs of localities.

The new allowance system will be applied from July 1, 2026.

Decree No. 381/2026/ND-CP takes effect from October 2, 2026.

The allowance regime stipulated in this Decree shall be applied from July 1, 2026 until the implementation of salary policy reform.

Commune-level officials and civil servants who are subject to the public service allowance rates stipulated in Clauses 1 and 3 above, and who, during the period from July 1, 2026 until the effective date of the Decree, have received a public service allowance lower than 55% of the standard allowance, shall be entitled to the difference to bring it up to 55%.

Decree No. 381/2026/ND-CP abolishes the relevant regulations on commune-level officials and civil servants in Decree No. 34/2012/ND-CP dated April 15, 2012 of the Government on the civil service allowance regime.
