At the meeting with constituents of National Assembly delegation No. 7 on the morning of October 3rd, Mr. Huynh Dang Khoa (a voter from Binh Khanh commune) raised concerns regarding the temporary suspension of mandatory social insurance contributions for business owners with revenue under 1 billion VND.
According to Mr. Khoa, from January 2026 to the present, business owners have received notifications from the Social Insurance Office of Nha Be - Can Gio that they are subject to mandatory social insurance contributions. The business owners have registered, have a unit code, and are participating in mandatory social insurance contributions.
However, according to current regulations, business owners with revenue under 1 billion VND are not required to pay mandatory social insurance. The business owner contacted the Social Insurance agency in Nha Be - Can Gio to inquire about the procedure for suspending participation from January to September, but has not yet received a response.
Mr. Khoa requested that delegates answer common questions from business owners participating in mandatory social insurance.
Responding to voters' opinions, a representative from the Ho Chi Minh City Social Insurance agency stated that the agency has taken into account Mr. Huynh Dang Khoa's suggestion to temporarily suspend mandatory social insurance contributions for business owners with revenue under 1 billion VND.
According to a representative of the Ho Chi Minh City Social Insurance agency, Decree 141/2026 stipulates that, starting from January 1, 2026, business owners who declare annual revenue exceeding 1 billion VND will be required to submit applications for compulsory social insurance for business owners.
For business owners who previously participated in mandatory social insurance, from July 1, 2025 to December 31, 2025, these owners will contact the social insurance agency to finalize a report and reassess their revenue for 2026, to see if it reaches 1 billion VND/year.
The Social Insurance agency will also determine the social insurance and health insurance benefits that the household head has already received and obtain information about their account number.
If, from January 2026 onwards, the household business owner's annual revenue is less than 1 billion VND, the social insurance agency will draw up a report and refund the money that the household business owner has paid from January 1, 2026 to September 30, 2026.
A representative from the Ho Chi Minh City Social Insurance agency stated that the household head should contact the local Social Insurance office, specifically the collection department. The collection department will receive the claim, create a record, and refund the money if the household head's income is less than 1 billion VND.
