
The government has just issued Decree No. 381/2026/ND-CP dated October 2, 2026, stipulating civil service allowances for officials and civil servants working in agencies of the Party, State, Vietnam Fatherland Front, and political -social organizations under the Vietnam Fatherland Front at the commune, ward, and special zone levels.
The decree takes effect from the date of signing. The allowance scheme will be applied from July 1, 2026, until the salary policy reform is implemented.
Decree No. 381/2026/ND-CP stipulates the following rates for civil service allowances:
The public service allowance, equal to 55% of the current salary plus leadership position allowance and seniority allowance exceeding the standard rate (if any), is applied to commune-level officials and civil servants who are not entitled to additional salary or income as stipulated in the Resolution of the Provincial/City People's Council on the payment of additional salary and income.
The public service allowance, equal to 25% of the current salary plus leadership position allowance and seniority allowance exceeding the standard rate (if any), is applied to commune-level officials and civil servants who receive additional salary and income according to the Resolution of the Provincial/City People's Council on the payment of additional salary and income.
In cases where commune-level officials and civil servants mentioned in Clause 2 above receive a salary or additional income lower than the 55% public service allowance, they are entitled to the difference to reach the 55% public service allowance.
The public service allowance is paid together with the monthly salary and is not used for calculating social insurance or health insurance contributions and benefits.
The decree specifies four periods during which allowances are not granted. Firstly, time spent on business trips, work, or study abroad, during which employees are entitled to 40% of their salary as stipulated in Clause 4, Article 8 of Decree 204/2004/ND-CP.
Secondly, periods of unpaid leave lasting one month or more. Thirdly, periods of leave during which social insurance benefits are received as prescribed by law. Fourthly, periods of temporary suspension from work or temporary detention.
Officials and civil servants who cease working in agencies and organizations within the scope of application at the commune, ward, or special zone level will no longer receive the civil service allowance according to the decree from the following month.
The Ministry of Interior is responsible for guiding, urging, monitoring, and inspecting the implementation of the decree.
